Arizona Dispensaries Sell Extracts, Despite Court Ruling

An appeals court ruling last month ruled that cannabis extracts are not protected under the state law allowing the cultivation and sale of cannabis for medical purposes. This will not stop dispensaries in Arizona from selling extracts such as oil, concentrates, and edibles.

The Arizona Department of Health Services is still determining whether or not to change their rules regarding extracts, but they did say that “criminal law does take precedence over department rules.” Should they decide to change their rules, this would leave Arizona dispensaries in a pretty precarious situation.

Nonetheless dispensary owners are saying that they will wait for the final ruling from the state supreme court, which should be coming soon. Lobbyist for the Arizona Dispensary Association Kevin DeMenna, told Phoenix New Times that the news was “alarming but not conclusive.”

He said, "It is our understanding that nothing dramatic or draconian will occur. It's a bad development in an otherwise positive environment."

It will be interesting to see what the Arizona Supreme Court’s final ruling is on this case, and whether or not it will affect the legality extracts in other states. Regardless of the outcome, legalization advocacy groups, patients’ rights groups, and patients themselves are prepared for the fight if the court does rule that they are indeed illegal. At this point we’re all just going to have to wait and see.
